If you are struggling with debt and you are or have been in debt management or an IVA then it is likely we can be of real help to you.

What will your work cost me?

Our fees will depend on the individual claims against you. You will not pay anything until we have completed an initial review of your claims. We will agree our fees with you before we take on your case. The total cost of our work will be fixed, you will never pay us any more than we agree for this work.

Those fees tend to be based on how much you owe. This is because it is a good indication of the level of work involved for us, and also the likely benefit to you. You can find more details of this structure here.

Although we agree a fixed monthly payment with you, we understand that sometimes life changes and we are committed to working with you, regardless of your circumstances. That means that if you find you are not able to afford those fees, we will do our very best to find a way to keep working for you.

Each case is unique and that means we can’t promise any specific reduction in the amount of debt you will ultimately have to pay.
What we do guarantee is:

  • You will not pay us anything until we have undertaken a full assessment of your circumstances and we have confirmed we can achieve success on your case.
  • We will reduce the amount of debt you have to pay by at least the amount of the fees you pay to us as an absolute minimum. In the unlikely event that we’re unable to do that then we will refund any difference.

This guarantee means that when you benefit from our highly specialist legal advice and assert your rights against the companies claiming you owe them money, you will not be put at a financial disadvantage.

Will I have to continue paying my debts while you are working?

You should never make payments to a company who cannot prove what they say that you owe. If you have not already investigated their claims, then you have the right to stop paying these companies unless and until they are able to prove this.

When you instruct us, you should stop making payment to any of these organisations. You should also stop any payments to your debt management company or IVA.

This is important – if you continue to make payments while we are acting, we cannot guarantee the results of our work. It is possible that you will be at risk of future action from these companies.

That is because our work is based on the evidence of their claim that the claimant companies are able to provide to us, including the omissions that they make. By this we meant the information which they are not able to provide. If you are still paying, then we cannot guarantee that documents not being provided is proof that they are not available. The company may have omitted to include documents that they do indeed have.

When you stop paying, we can be certain that these companies are providing all of the documentation that they have to support their claim.

We will guide you each step of the way and advise you if any of these companies are able to prove their claim. At that point we will likely advise you to make some payment arrangement with the company directly. You can download a template letter to send to your creditor here.

Will I have to go to court?

You should not have to go to court as a result of our work.

You are defending these claims that are being made against you, you are not making any claims and therefore do not need to make any application to the court to defend your rights.

Although it is very unlikely, one of your claimants may issue a claim against you either while we are working, or after our work has finished. If you receive any documents from the court, including a claim form, it is extremely important that you send this to us as soon as you receive it.

If the claimant organisation were to issue a claim against you, you would be the Defendant in the proceedings and would likely chose to instruct a lawyer to represent you. Galahad & Co. can make an introduction to a specialist solicitor who will be happy to represent you.

That engagement will be directly between you and your lawyer. This will also be subject to a separate fee agreement.

Will I need to deal with the companies making claims against me?

You do not need to speak with any of the creditors who you have instructed us to deal with, unless you want to. If you are in a debt management plan or an IVA, we can also contact that company directly. You do not need to get in touch with them yourself, although they may ask for confirmation of our instruction.

Those companies have a responsibility to co-operate with third parties acting on your behalf. If you continue to receive automated communication or the companies do not stop contacting you then you should tell us and we will contact them.

It is very important that you send us copies of any correspondence that you receive while we are acting. You can send this via email to hello@galahadandco.co.uk.

We know the stress and concern that constant communication chasing payment can cause. Debt collection companies know this too and may try to bully you into paying them by contacting you directly. The emotional burden of debt can have a severe impact on all aspects of your life and we take this part of our work extremely seriously.

Will my credit rating be affected?

Galahad & Co. will not affect your credit report. Our work is not designed to ‘clean up’ your credit record.

If your accounts have not already defaulted, and you stop paying them, then this is likely to have a severe impact on your credit rating. That is regardless of whether you stop paying because you have instructed us, or if you have entered into an IVA, debt management or other debt solution.

What do you need from me?

We would request that you respond quickly to any requests which we make for information or instructions.

In order to review your case, and give you our opinion about the likely outcome of our work, we need as much information as possible about the debts that you are facing. This may include:

  • Name of original creditor
  • Name of current creditor (if different / the debt has been sold)
  • Balance on the account
  • Date of agreement / account opening
  • Date of default (if relevant)

We may also need more information from you as your case progresses. For example we may need to speak to you about the checks your creditor performed before approving your application; or we may need personal details like your address history. Any data that you trust us with will be treated confidentially, as set out in our Privacy Policy.

We ask that you work closely with us and keep us updated about your circumstances. It is very important that you share details of any correspondence that you receive from your creditors. Without this, we may not be able to complete our work.

Please also ensure that the monthly fees are paid on time so that we can concentrate on your case and continue to offer the fee guarantee.

What promises do you make?

Above all else, we value honesty in our dealings with people. We are only providing this service because we believe it will be of real benefit to you.

The promises we can make are:

Can’t I just do this myself and save money in the process?

The short answer is no, most people do not have an in depth knowledge of the Consumer Credit Act and the Consumer Credit Regulations and are unlikely to know whether the claimant company has properly complied with its statutory duty.

The starting point for our work is making a request for information. There is not reason why you cannot make this initial request yourself, but it is unlikely that you be able to analyse the information provided without specialist help.

It is important to understand that a request for information is just the starting point of the process and when the accumulated skill and experience of our legal and support team comes to the fore.

There is a lot of information about unenforceable debt online. Some of this information is very useful, but the vast majority is misleading and inaccurate.
